“The overall importance of alternative dispute resolution (ADR) methods in Latin America cannot be overstated. “A bad settlement is better than a good trial”, runs an old adage in Spanish.  Many who have been involved in litigation will know that the sentiments underlying this saying are not particular to Latin America.  Yet it seems that, for many years, in much of Latin America this intuitive knowledge was not matched by institutional or professional initiatives to foster ADR.  With the exception of domestic arbitration for private business disputes, it seemed that direct negotiation, occasionally assisted by a respected third party (an elder neighbour, a cleric, a professor, a legal clinic), summed up the available options.”
